FORMATION OF THE PURCHASE AGREEMENT
A purchase agreement is formed between Hyvinvointikylä and the consumer customer (“the Buyer”) when the Buyer notifies Hyvinvointikylä of their intention to purchase a specific service package, and Hyvinvointikylä agrees to provide or deliver it. These General Terms and Conditions for Consumers (“Terms”) apply to all agreements between Hyvinvointikylä and the Buyer. The Buyer confirms having read and accepted these Terms before the agreement enters effect.
Customers under the age of 18 must have a guardian’s consent to order products or services from Hyvinvointikylä.
SCOPE OF APPLICATION
These Terms apply to all products and services offered by Hyvinvointikylä to consumer customers (e.g., courses, coaching sessions, on-site or online services, and physical product sales). Hyvinvointikylä may update or amend these Terms at any time by publishing the revised version. The new Terms will apply to all agreements made after the date of change.
SERVICE TERMS
Hyvinvointikylä determines the content and duration of its services. Each service package includes only what is specified in the service description. Hyvinvointikylä reserves the right to modify schedules, content, or other arrangements. Customers will be informed of any changes as soon as possible.
The customer must inform Hyvinvointikylä of any allergies (e.g., food, animals) or limitations that may affect the safe delivery of the service.
PRODUCT SALES TERMS
When visiting Hyvinvointikylä, consumers may purchase physical products, which are sold in accordance with the current Finnish consumer protection legislation.
PRICES
All prices quoted to consumers include applicable taxes and charges at the time of purchase. Any handling or additional fees will be clearly stated separately.
PAYMENT TERMS
Services and products purchased online must be paid in advance and in full in accordance with Finnish distance selling laws and regulations. If this payment method is not suitable, an alternative arrangement may be made in writing. For courses booked via email or similar registration, payment will be made after registration using a mutually agreed method (e.g., ePassi, MobilePay, or invoice). Payment in full guarantees the customer’s place on the course.
Hyvinvointikylä follows fair invoicing and collection practices in compliance with Finnish consumer protection laws.
CANCELLATION TERMS
Consumers have a 14-day right of cancellation for orders made online or by email, unless they have already started using the digital service (for example, by participating in an online class). After this period, the registration or purchase becomes binding, and payments will not be refunded under the Finnish Consumer Protection Act. Failure to use the service, in full or in part, does not release the customer from payment obligations, nor does it entitle them to a refund, unless otherwise agreed in writing. Customers may transfer their course registration to another person by notifying Hyvinvointikylä in writing before the course begins.
SERVICE CANCELLATION OR INTERRUPTION
Hyvinvointikylä will notify customers as early as possible if a service or course must be cancelled. If Hyvinvointikylä cancels a course before it begins, for any reason, it will refund the course fee or offer a replacement course of equivalent value.
Hyvinvointikylä is not responsible for any indirect or direct costs or damages resulting from such cancellation.
DATA PROTECTION
Hyvinvointikylä processes customer personal data in accordance with its current Privacy Policy, available at www.hyvinvointikyla.fi/tietosuojaseloste.
FORCE MAJEURE
Hyvinvointikylä is released from its contractual obligations for the duration and extent that performance is prevented by a force majeure event. A force majeure event refers to an extraordinary, unforeseeable situation beyond Hyvinvointikylä’s control that could not reasonably be avoided or overcome — for example, war, power outage, fire, government action, thunderstorm, natural disaster, or any comparable event outside the parties’ influence.
APPLICABLE LAW AND DISPUTE RESOLUTION
These Terms are governed by Finnish law.
Any disputes between Hyvinvointikylä and the consumer shall first be resolved through negotiation. If no agreement can be reached, the competent court of first instance is Länsi-Uusimaa District Court (Länsi-Uudenmaan käräjäoikeus). Alternatively, the consumer may bring action in the district court of their place of residence.
Consumers also have the right to refer disputes to the Consumer Disputes Board (www.kuluttajariita.fi).
Before doing so, the consumer must contact Consumer Advisory Services (www.kuluttajaneuvonta.fi).
